October 2017 - First Offense Dismissed (Non US Citizen)
Facts:
The police originally stopped due to speeding and committing a marked lanes violation. Once pulled over, the police officer instructed my client to perform Field Sobriety Tests. Specifically, he was asked to perform the Horizontal Gaze Nystagmus, 9 Step Walk and Turn Test, One Leg Stand, and recitation of the alphabet. After performance of the tests, the police officer believed my client showed signs of impairment. My client denied the portable breath test and was placed under arrest and transported to the police department. My client also refused the breath test at the police department.
Maximum Penalty:
Imprisonment for not more than 2 1/2 years, or not less than $500, or both, plus $50 Victims of Drunk Driving Assessment, $250 Head Injury Assessment, and license revoked for 1 year.
Outcome:
Due to the motions I filed, my client's case was dismissed. My client is not a citizen of the United States and has his electrician license. I saved his citizenship and his professional license, which is an amazing outcome. Client is extremely thankful he gets to stay in the country and keep his job.
