May 2018 - First Offense Dismissed
Facts:
Our client was driving back from dinner when she crossed over the double yellow lines and was consequently pulled over. The police officer claimed she had parked on the curb and noted that as a sign of intoxication. He also claimed my client had slurred speech and glossy/red eyes. She refused Standardized Field Sobriety Tests and refused the breathalyzer. She was then charged with OUI-Liquor, Negligent Operation of a Motor Vehicle, Marked Lanes Violation, and Speeding.
Maximum Penalty:
Imprisonment for not more than 2 1/2 years, or not less than $500, or both, plus $50 Victims of Drunk Driving Assessment, $250 Head Injury Assessment, and license revoked for 1 year.
Outcome:
Although our client's case was on the path to trial, Attorney Bernard was able to negotiate with the prosecutor and have the OUI charge dismissed. Her booking video helped in this case because she did not show an overwhelming amount of intoxication. She was found not responsible for her two other civil charges but negligent operation of a motor vehicle was continued without a finding. Great result!
