First Offense Dismissed After Motion to Suppress

Facts: Police claimed that my client was operating a motor vehicle while under the influence of intoxicating liquor.

Maximum Penalty: 2 1/2 years in the house of corrections not less than $500 fine and not more than $5,000 fine or both imprisonment and fines and license revoked for one year.

Outcome: Successfully argued a motion to suppress my client's statements due to the police's failure to inform my client of his Miranda rights after he was arrested. The Court allowed the motion. As a result, the Commonwealth offered to dismiss the OUI charge, my client accepted, and the Court adopted the dismissal.
