February 2018 - First Offense Dismissed


The police originally stopped my client after receiving a call reporting my client has an erratic operator. My client performed Standardized Field Sobriety Tests and submitted to a Portable Breath Test as well as the breath test at the police department. The breath test resulted in a .18. Consequently, my client was charged with OUI-Liquor, First Offense, and negligent operation of a motor vehicle.  

Maximum Penalty:

Imprisonment for not more than 2 1/2 years, or not less than $500, or both, plus $50 Victims of Drunk Driving Assessment, $250 Head Injury Assessment, and license revoked for 1 year. 


I filed a motion to suppress for the breath test and other evidence. As a result, the defendant was found not guilty for OUI-Liquor. Amazing outcome!
